Section A - Software Licensing Agreement

By submitting your order for Cast-Control, you agree to all terms and conditions as stated in this document for the duration of the term of the license.
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY.
If you do not agree with these terms and conditions, please DO NOT order this software. You (The Customer) are responsible for everything that occurs as a result of acceptance of this license and in use of the software it licenses.

1. LICENSE TERMS
The Cast-Control license allows the user to install the software once per site, i.e. Host/IP validation. This allows multiple installation of Cast-Control per server, but only one per website. This is enforced using the ionCube encoder. If the customer requires the software to be run on more than one website, then an additional license must be purchased.

2. SOFTWARE RIGHTS
a) Cast-Control retains the copyrights to any software produced by Cast-Control or any derivative company or venture.
b) The Customer will NOT attempt to obtain a copy of the source code through unlawful means, including but not limited to the decoding of official or unofficial source code or by compromising the Cast-Control server.

3. LIABILITY
CAST-CONTROL WILL NOT TAKE ANY RESPONSIBILITY FOR ANY PROBLEMS CAUSED BY OR ASSOCIATED THROUGH THE USE OF ITS SOFTWARE. IT IS THE RESPONSIBILITY OF THE USER TO MAKE SURE THAT THE SYSTEM THAT CAST-CONTROL IS INSTALLED ON MEETS THE MINIMUM REQUIREMENTS AND HAS UP TO DATE VERSIONS OF ALL SOFTWARE REQUIRED. CAST-CONTROL WILL NOT COVER THE COSTS OF ANY LOST PRODUCTIVITY OR DOWNTIME AS A RESULT OF THE INSTALLATION AND/OR UTILIZATION OF THE SOFTWARE.

4. MINIMUM CONFIGURATION
The Customer is responsible for ensuring that the system that Cast-Control is to be installed on meets the minimum requirements as stated on the Cast-Control website. These requirements are subject to change.
5. PAYMENT SCHEDULE
The Customer is responsible for and agrees to completing invoices on time and within schedule.
Cast-Control reserves the right to bill for and suspend orders where the customer has failed to complete payment for.



6. TECHNICAL SUPPORT AND UPDATES
Depending on the license purchased by the customer, different terms of support and updates apply. The following is a list of different support/update options.
Monthly License: Support and upgrades throughout the life of the license or project.
3 Monthly License: Support and upgrades throughout the life of the license or project
Yearly License: Support and upgrades throughout the life of the license or project
Owned: Support and upgrades for a period of one (1) year after purchase.
Updates are taken care of through the Cast-Control Updating System which is built into every installation. Support is provided using a ticket based system. The customer will receive the support mail in the welcome email.

7. LICENSE TERMINATION
This license may be terminated by Cast-Control at any time and for any reason including those outlined in this document.
8. REFUND POLICY
Cast-Control DOES NOT issue refunds for its software. Any decisions regarding the purchasing of the software should be made within the 10 day trial period.

9. LICENSE APPLICABILITY
This license is valid in a court of law and applies as a contract to any case regarding a conflict between any customer and any member of staff. This license is in accordance with Australian Law.

Section B - License Reseller Agreement

By submitting your order for Cast Control, you agree to all terms and conditions as stated in this document for the duration of the term of the license.

If you do not agree with these terms and conditions, please DO NOT order this software. You (The Customer and Reseller) are responsible for everything that occurs as a result of acceptance of this license and in use of the software it licenses.


1. LICENSE TERMS
The Cast Control license allows the user to install the software once per site, i.e. Host/IP validation. This allows (limited) multiple installation of Cast Control per server, but only one per website. This is enforced using the ionCube encoder. If the customer requires the software to be run on more than one website, then an additional license must be purchased.

The reseller agrees that their account, order, invoice and/or license/s may be suspended/terminated by decision of cast-control if cast-control believes the reseller is not abiding by this document or otherwise believes the actions may damage cast-control as a business and/or product. Cast-Control is not obligated to contact the reseller though an attempt should be made before suspension or termination.


2. DISTRIBUTION TERMS
The reseller must not offer the same license to multiple persons, this will also result in suspension of the customer/resellers account, order and/or license.
The reseller must always have at least 1 license available for distribution while advertising on their website, if no licenses are available the reseller must cease advertisement IMMEDIATELY.

The Resellers Customer (The licensee) is subject to the Cast-Control Software Licensing Agreement and the Reseller agrees to subject this agreement to their respective customer before the purchase of the license. Both the Reseller and the licensee are subject to the agreement and the License, Regardless of the Resellers Customer viewing the agreement is still subject to these terms.

The reseller agrees NOT to provide the cast-control files to anyone besides the customer they have directly sold the license too. Under no circumstance should the files be distributed publically or to any persons not intending to use cast-control. If the reseller is suspected of distributing such files, we will attempt to contact them and their account, order and/or licenses may be suspended by decision of cast-control.

The reseller agrees to handle customer contact including feedback, support and service by their own methods and should advise their customers to contact themselves. If the reseller is unable to provide an adequate answer, they may further contact cast-control on their customers behalf.



3. LIABILITY
